Best Friends Animal Society – Gap Analysis Tool Terms of Use
The following terms of use govern the provision and use of information (“Information”) submitted by any individual or organization “Organization”) through the Gap Analysis Tool. By submitting Information, you agree to these Terms of Use.

1. Permission to Use Information. Organization grants BFAS permission to use any Information submitted by Organization to BFAS at no cost to BFAS. This permission is granted on a non-exclusive, royalty-free, permanent basis. Organization may give others permission to use the Information, in addition to BFAS;

2. Permitted Uses of Information. BFAS may use the Information for any lawful purpose it deems to be in furtherance of its charitable mission, including by compiling it with the data of other participating animal welfare organizations. BFAS may include the Information in data analysis projects, and may disclose, publish, or present the results of those projects for any lawful purpose, without further attribution to or permission from Organization.

3. Organization Retains Ownership of Information. Organization does not transfer ownership of the Information to BFAS, and these Terms of Use do not limit or restrict in any way Organization’s ownership or use of the Information.

4. Communication from BFAS. By submitting information via the Gap Analysis Tool, Organization agrees to receive email and other communications from BFAS and agrees to BFAS’s TERMS & CONDITIONS AND PRIVACY POLICY.

5. Warranty Disclaimer. THE GAP ANALYSIS TOOL IS PROVIDED BY BFAS "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE GAP ANALYSIS TOOL IS WITH USER. SHOULD THE GAP ANALYSIS TOOL PROVE DEFECTIVE, BEST FRIENDS WILL NOT BE LIABLE FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE GAP ANALYSIS TOOL.
