Another Texas city scheduled to discuss banning pit bulls.
The topic of breed specific legislation (BSL) is as hot as the state of Texas right now. Madisonville,
Duncanville, and only last week Cedar Hill, have all enacted legislation that could allow for the prohibition of certain breeds of dogs.
This is an effort to overturn
Texas Health and Safety Code Title 10 Chapter 822, Section 822.047, which makes the municipal banning of breeds illegal. The code specifically states “A county or municipality may place additional requirements or restrictions on dangerous dogs if the requirements or restrictions: (1) are not specific to one breed or several breeds of dogs; and (2) are more stringent than restrictions provided by this subchapter.”
Now the City of Aubrey is holding a
public hearing tonight “to consider public comment regarding the adoption of an ordinance restricting the possession of Pit Bulls in the City of Aubrey, Texas.”
These precedents are more dangerous than the many of the beloved family pets such blanket legislation would ban. These resolutions do not take an individual dog’s aggressive tendencies into consideration, but rely solely on the breed of dog. Please take action; while today it may be Aubrey, tomorrow it could be your own town.
HOW TO HELP:While municipalities have an obligation to protect their citizens from dangerous animals; BSL is
not the way. Instead, suggest a
Community Safety Program as an alternative.
If possible, attend the Public Hearing
tonight at 5:30 p.m. to voice your opposition.
