All Creatures Great and Small About to Close in NC

Groups & individuals coming together to help animals in need but they still have a way to go and a short time to do it in!

All Creatures Great and Small has been under a longtime investigation that is finally coming to a close. Click here to read why the state of North Carolina wanted all the animals removed from this facility by January 31st.

While there were many different species being housed at All Creatures Great and Small, we have been told that the rabbits and guinea pigs have already been scurried away to rescues that can give them the care they need.

All Creatures Great and Small have some of their animals listed on Petfinder. Click here to see a representation of the animals that could still be available from them. It does not seem up to date.

I was told Dr. Lee Hunter from the Dept of Agriculture could answer all our questions about animal availability, groups that have taken animals, and getting images to illustrate some of the beautiful faces that are still left. While I was unable to reach Dr. Lee Hunter for an update (he will be out of the office until next week), I was able to speak with Brian Long, director of NCDA&CS Public Affairs Division on how this massive rescue effort is going!

“The response has been so positive! There have been a lot of inquiries from groups and individuals. Many people have been going to the shelter in the past few weeks and it’s encouraging that the public has come together to help these animals out,” Mr. Long conveyed.

He also said that the below instructions for filling out the Adoption Forms are for Organizations Only! He said individuals should go straight to All Creatures Great and Small to adopt a companion animal from there. He assured me they were still open to the public. I was unable to reach them by phone to confirm, but we take the Dept of Ag on their word when it comes to placing animals in need of rescuing! (okay, that's a wink-wink, but we're believing them on this, so get down there!)

The following is the Press Release from January 18th by North Carolina’s Department of Agriculture that pertains to Organizations Only!

The time has finally arrived. By court order, the North Carolina Department of Agriculture and Consumer Services (NCDA&CS) has the authority to direct the removal of at least 350 animals from the All Creatures Great and Small (ACGS) site in Hendersonville, North Carolina. I respectfully ask that ANY group that has space please make arrangements to accept as many animals from ACGS as quickly as possible.

The current on-site animal count today is as follows: 284 dogs & 220 cats

The procedure for adopting from All Creatures Great and Small as a rescue/humane group at no cost to your group is as follows, and must be adhered to:

1. Click here to go to our website, then click on the ACGS button, download and complete the Request for Adoption form and fax it to our Animal Welfare Section.
2. We will verify that you are a legitimate rescue or humane organization, provide your entity’s name to ACGS so they will know you will be coming soon, and respond to your contact within 3 days (probably much quicker than that).
3. You will sign a brief MOA that releases NCDA&CS from any liability, as required by our attentive legal support.
4. You can then go to ACGS and request to adopt however many animals your facility can properly manage. Please do not go before you finish steps 1-3.
5. Upon completion of the adoption, you then will fill out the Notice of Adoption form and fax it to our office, so we can maintain an accurate count of animals removed under the Consent Order.
6. You will be thanked profusely by all animal lovers, including us in NCDA&CS, for helping get these animals into appropriate situations!

Officials confiscate 44 animals

Animal control officers seized 44 animals from a Flat Rock home occupied by Kim Kappler, founder of the former All Creatures Great and Small shelter, and plan to charge her with 44 counts of animal mistreatment, among 85 misdemeanor charges.

Kappler also faces the possibility of more than $4 million in civil fines that can be levied under the county’s new animal control ordinance after the raid Tuesday night at a home she occupied.

Henderson County Sheriff’s Office Animal Enforcement confiscated the animals at the home, located at 2731 Greenville Highway, late Tuesday after receiving several complaints of odor and barking dogs. Village of Flat Rock officials say residents have been complaining about smells and noise from the house since last year, worries also shared by deputies when they arrived.

“We were very concerned about the barking dogs, cleanliness of the home and the health of the animals,” said Sheriff’s Office Lt. Ben McKay.

All the animals except for two dogs were inside the house, said Pam Brice, the county’s public information officer. She described conditions in the home as deplorable due to animal waste.

She also said the county is hard-pressed to take all the animals but cannot adopt them out unless Kappler gives them up.

“We are at full capacity at the animal shelter now,” Brice said. “Pending court investigation and potential civil and criminal charges, the animals must be housed at our shelter and cannot be adopted out unless she relinquishes their custody to the county.”

In total, 29 dogs and 15 cats were removed, and county staff say some cats may have gotten away. Four dogs were taken to a veterinarian for immediate medical treatment and the rest were placed at the Henderson County Animal Services Center on Stoney Mountain Road.

Kappler faces 44 counts of mistreatment of animals, with fines totalling $3,982,000. She also could be charged with 34 counts of failure to comply with the companion animal laws, which state a permit is required for more than 10 animals. Fines for those counts could reach as much as $307,000. She also was charged with seven counts of failure to have rabies shots current, violations which carry maximum civil fines totaling $126,700, county officials say.

Although she admits she had more animals than the ordinance allows, Kappler denies any mistreatment and that any animals did not have current rabies vaccinations.

Kappler was founder of All Creatures, which shut down in February after years of battles with Hendersonville and the state over poor conditions for animals at a shelter on Seventh Avenue.

An ongoing problem

Kappler, who rents the 1,150-square-foot home, was present during the seizure of the animals. County officials said they had given her warnings as early as January and advised her to come into compliance rather than face penalties and impoundment of the animals, McKay said.

“Back in January there were 17 animals, so it obviously doubled, and last night several cats got away,” said Brice.

The county’s new animal control ordinance says people who keep more than 10 animals must obtain a companion animal permit.

“It is a fairly simple process,” Brice said. “You go and fill out an application and you show you have adequate living facilities for the animals. She was advised back in January and she never got those permits.” Flat Rock Mayor Bob Staton said he first complained about the home in January when the state veterinarian was in the process of shutting down All Creatures.

“I wrote a letter to the office of the state veterinarian to let them know that she had a large number of dogs, and we did not know how many, but we knew many dogs were at her property here in Flat Rock,” he said. “We had had complaints for six or eight months from the neighbors about barking dogs and I personally saw a number of dogs, anywhere from four to six at a time, in her backyard over a several month period. I contacted the state veterinarian to suggest they not overlook what we call All Creatures South here in Flat Rock.”

Staton said he also contacted Sheriff Rick Davis and asked that the county’s newly constituted animal control unit investigate the situation. Flat Rock officials considered Kappler in violation of the town’s zoning ordinance for “conducting a kennel operation basically in residential property,” Staton said, but never took zoning enforcement action pending the outcome of the sheriff’s probe. The village is investigating a travel trailer that appeared on the property about three weeks ago as a zoning violation.

“That (the trailer) may have been used to house the animals,” the mayor said, adding, “We are planning to cite her for that violation. We did not because of the investigation by the sheriff that began almost immediately.” Staton said Kappler told him after he wrote the letter of complaint that she “didn’t want to be a nuisance in Flat Rock and that she was leaving Flat Rock,” but did not say where she was moving. He said he was glad the Sheriff’s Office removed the animals.

“I certainly am. It is really a problem for us here. The odor within a few feet of the house on the outside is very bad and I can imagine what it is on the inside.”

The latest incident

Animal Enforcement received a complaint Monday about odor and barking dogs, which Brice said resulted in the seizure and impoundment of the animals.

Assistant County Manager Selena Coffey said officers felt sure there were several animals they had missed, but they couldn’t get to all the cats in the house.

”We went out and had no idea we would find 44 animals,” she said. County staff will continue to search for any animals that may have gotten away.

County commissioners discussed the seizure after Coffey updated them during a tour of Blue Ridge Community College’s new technology building Wednesday morning. Commission Chairman Bill Moyer said he is confident county staff took the correct action. Moyer also said he was afraid the situation would get more severe and was glad county officials took action now.

“It is saddening that we must take drastic measures to address animal welfare issues, but it’s heartening that we have a dedicated staff in Henderson County Sheriff’s Department Animal Enforcement and Animal Services Department to protect the welfare of the citizens and animals of Henderson County.” Coffey said.

“Our staff puts a lot of heart into their jobs and we have come a long way in enforcing the animal ordinance approved by the Board of Commissioners.”

Jarlar, I live near Asheville and have been following developments at ACGS. Have not been there, though. Can you tell me about the condition of the cats? Do you have any info about the organizations that will take them in? I'm concerned this is just leading to mass euthanasia, as all the shelters I know of in the entire area are kill shelters (except for Catman, but he's always filled to capacity). Best Friends, can you come in and help get any of the animals to safety?! I'll volunteer on-site with you.

jarlar, thanks for the update. It's nice to talk to someone who has been there. Do you know if the dogs are up to date on vaccines? Did they supply you with medical records? We have space at our shelter up here in Maine and would like to help out. So far, I have been unsuccessful obtaining information from the State vet.

Any information you could provide would be very helpful. Thanks.

My rescue visitation was heart wrenching, but very enlightning also. I had been told horror stories before my visit. overwelming numbers is the problem, and not enough space. The dogs were clean, all dogs had dog houses and clean enviroment food and water. I was thrilled to see all of the volunteers(at least 30) there working through the tears of sadness and joy when we would decide who would be coming home with us. ALL of the dogs are fat!! Thanks god. I Rescued 3 dogs, and all the rabbits and guinea pigs last saturday. I have 4 or 6 more that I would love to rehome also. I am desperatly looking for Foster Homes in the Statesville area!! anyone interested??? I can go immediatly and pick them up if I have a loving person to foster until they find there forever home. I do adoption fairs 2 to 3 X mo, and petfinder is uploaded immediatly. Update All my dogs are highly adoptable, Heartworm Neg, and one was put on a diet. haha
Please help these very sweet babies. (there are a couple hundred.) Some are ready to rehome now, (Donnor, Slim, Funny faced rottie, little brown chubby dogs everywhere, and a cutie little boxer beagle X) Just to name a couple off the top of my head.
Others have developed pack mentality but they can be rehabilitated with patience and kindness.
I am not a person that feels good aboout euthanasia but in some cases it is more humane than to continue the pain for some.
Their are some dogs that really need to be relieved of the madness inside their own heads.

I am available for any questions and comments please this is our state, and these are our dogs and please do not forget the 200 CATS TOO!!!!!!!! I can bring some kitties home too!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

26 January 2008; We were just at ACGS and there are still tons of loving dogs and cats. Yes, the shelter is in very poor shape but there is no money and the volunteers are trying like crazy to do their best. ONE WEEK REMAINS before the state comes in and takes the animals and puts them down. PLEASE!!! If you have space, come get these loving dogs and cats. There were so many loving animals it will make you crazy. They have ONE WEEK before they are removed and killed. Now this shelter is in CRISIS. Please, if you have room for just one dog or cat, get to this shelter and adopt one of the loving cats and dogs. So, so many of them will be put down.
